Subject: FOIA Request – Complete In-Election Timestamped Voting Machine Logs – General Elections November 3, 2020 & November 5, 2024

Pursuant to the Freedom of Information Act (5 U.S.C. § 552) and EAC regulations at 11 C.F.R. Part 901, I request the following records in the possession, custody, or control of the U.S. Election Assistance Commission:

  1. The complete, unredacted in-election event logs (including cast vote records and ballot images when linked) generated by any federally certified voting system used in the November 3, 2020 federal general election and the November 5, 2024 federal general election, limited exclusively to the periods when polls were legally open (including early voting periods recognized by each state for those general elections).
    These logs must contain, at minimum, for every single ballot transaction:

    • Full transaction-level timestamp (date and time to the second or millisecond)
    • Unique machine/serial number or precinct identifier
    • Event description (ballot accepted, rejected, overvote, undervote, jam, error code, etc.)
    • Cast Vote Record (CVR) with corresponding exact timestamp
    • Ballot image file name or hash with its exact scan timestamp
  2. Any national-level datasets, aggregated files, clearinghouse submissions, or compiled extracts of the above timestamped in-election logs for the November 3, 2020 and November 5, 2024 general elections that the EAC received from states, vendors, or testing laboratories under its HAVA clearinghouse authority (52 U.S.C. § 20901 et seq.).

Narrowing statement:
This request is strictly limited to in-election logs from the two specified general election dates only (November 3, 2020 and November 5, 2024) and only for the hours polls were open. I do not seek midterm, primary, special-election, pre-election L&A, post-election audit, or any other data outside those two Election Days.

Format requested: Native electronic format that fully preserves original timestamps and sequence (CSV, JSON, database export, raw vendor log files, etc.).

I request a full public-interest fee waiver under 5 U.S.C. § 552(a)(4)(A)(iii) — disclosure is likely to contribute significantly to public understanding of federal election integrity and there is no commercial interest. If waiver is denied, I agree to pay up to $25; contact me in advance if fees will exceed that amount.
